This agreement between us is legally binding, and governs each and every transaction between Goddards Brewery Ltd and you, our customer. We reserve the right to make changes to it from time to time as needs arise, so we suggest that you save/print a copy of it at the time you place an order. We fervently hope, though, that you will never have need to refer to it again.

APPLICABLE LAW
Goddards Brewery Ltd is an incorporated business domiciled in the United Kingdom. Sales and any other contractual relationships between us will be made according to the terms of this agreement, and are deemed to be made in England and subject to English law. In the event of a dispute arising between us, then we both submit to the exclusive jurisdiction of the English Courts.

WHO ARE YOU DEALING WITH?
Goddards Brewery is the trading name used by Goddards Brewery Ltd, whose Registered Office, and place of business is Barnsley Farm, Bullen Road, Ryde, Isle of Wight, PO33 1QF. The company is registered in England as number 2338202. There are no visitor facilities at this address.

SEVERABILITY
In the event that any of the terms of this agreement is judicially held to be unenforceable, then the remainder of it will remain valid and enforceable.

IN THIS AGREEMENT:
Goddards Brewery Ltd AGREES:

  • Not to use 'cookies' or any other means to collect information to identify you when you browse this site.
  • We will not store information about you (other than transaction details) unless you specifically consent to it.
  • We will not disclose, in any way, any details about you to any third party (other than, of course, the delivery address of goods purchased for the shipper's use). The only exceptions to this being if we need to remedy your breach of this agreement, or if we believe we are validly required to do so by law or in response to a request from a law enforcement or government agency.
  • We always use our best endeavours to accurately describe and illustrate our products and services, but errors or omissions can occur, and if they do we will rectify them as soon as we are made aware of them - if at all possible.
  • We will make no charge for any order cancelled by e-mail prior to starting work on that order, but reserve the right to charge for time spent prior to cancellation.
  • We will replace (subject to stock), or give a full refund for, any goods damaged in transit, including outward and/or return shipping costs as appropriate. However, we are insured, and you must return the damaged goods to us in order for us to be able to make a valid claim. You should contact us by e-mail to arrange for this, which we will normally do with the shipper concerned.

YOU, OUR CUSTOMER, AGREE:

  • That you are legally entitled to enter into a contract with us (in other words, you are authorised by your business to make purchases and it is solvent, or you personally are old enough, sane etc.).
  • That you use your correct name, address and other details and that there are sufficient funds available for your purchase. We expect payment before your order is despatched.
  • That there is someone available to receive, and authorised to sign for, the goods during the working day. Shippers get very bored with repeatedly trying to make deliveries to unattended premises! In these circumstances you might consider asking us to deliver to a neighbour, or to your work address.
  • It is imperative that goods are carefully examined on receipt in the presence of the shipper, and that you sign for goods as 'damaged on receipt' if they are indeed damaged. Signing for the goods as 'unexamined' or similar is not acceptable, and we will not make any refund in these circumstances (see above).
  • You agree to indemnify Goddards Brewery Ltd from any loss to yourself or any other party for any direct or indirect loss or damage however caused.
  • You agree to indemnify Goddards Brewery Ltd from any failure by Goddards Brewery Ltd to fulfil its obligations under this agreement caused by circumstances outside our control.then please give us no less than 48 hours notice prior to delivery.
